How quickly can you review a contract?
Most contracts and Section 32 vendor statements are reviewed and reported on within one to two business days. If you are bidding at auction or under a cooling-off deadline, tell us when you send it and we will prioritise the review.
Do you offer fixed fees?
Yes, for most transactional work, conveyancing, wills and estate planning, company and trust set-up, lease reviews and probate applications are all quoted as a fixed fee in writing before we start. Litigation and complex family matters are scoped by stage, so you know the cost of each step rather than signing a blank cheque.
Can everything be done online?
Yes. We act for clients across Victoria using electronic signing, video meetings and online settlement through PEXA. Wills and powers of attorney require a witnessed signing, which we handle in our Richmond office or by arrangement.
Do I need a lawyer before signing a contract?
For property, almost always. Once you sign a contract of sale in Victoria you are bound to it, subject only to limited cooling-off rights that do not apply at auction. A review before signing costs a fraction of what it costs to get out of a bad contract afterwards.
What documents do I need for a will?
Nothing formal to begin. A list of your assets and roughly what they are worth, details of any superannuation and life insurance, who you want to inherit, who you want as executor, and, if you have children under 18, who you want as guardian. We work through the rest with you.
How long does probate take in Victoria?
The Supreme Court usually issues a grant within four to eight weeks of lodgement. Preparing and advertising the application takes two to four weeks before that, and administering the estate afterwards commonly runs six to twelve months, longer if property is sold or a claim is made.
Can an SMSF buy residential property?
Yes, provided the fund's investment strategy allows it, the property is not acquired from or occupied by a related party, and any borrowing is done through a compliant limited recourse borrowing arrangement with a bare trust. We set up the structure and work alongside your accountant and adviser.
What is the difference between a trust and a company?
A company is a separate legal entity that owns assets and trades in its own right, taxed at the company rate with liability limited to the company. A discretionary trust is a relationship in which a trustee holds assets for beneficiaries, giving flexibility to distribute income tax-effectively but without a fixed entitlement. Many structures use both, a company acting as trustee of a trust.
