Recycling an old section 32
Stale certificates and missing disclosure can let a buyer rescind. It is prepared from current certificates.
Launching before the vendor statement is ready
An agent cannot take offers without it, and a rushed statement is where errors creep in.
Forgetting the ATO clearance certificate
Without it the buyer must withhold part of your price and send it to the ATO. Apply early.
Getting the GST position wrong
New builds, subdivided land and enterprise sales can attract GST. The contract has to state it correctly.
Releasing the deposit too early
Early release is only allowed on strict conditions, and letting it go too soon exposes you if the sale falls over.
Agreeing to an extension when the buyer cannot settle
A buyer who misses settlement is in default. Waiting can weaken a position that was strong on the day.
